Introduction

The University of Toronto Art Centre (UTAC) has the direct care of three collections:
1. the University of Toronto Art Collection on the St. George Campus
2. the Malcove Collection, and
3. the University College Collection.

These collections have been created primarily through the generosity of donors over a period of 175 years, and they are held as a public trust for future generations.

Are you interested in donating works art to one of these collections? If so, you will need to contact the UTAC Director or Curator so that the work can be brought to the UTAC Acquisitions Committee for approval. The approval of works of art will be based on the following criteria outlined in the University of Toronto Art Collection Policy:

a) artistic merit and cultural value

b) relevance to the collections, present and future, of the University of Toronto, and to the teaching and research components of the academic mission of the University

c) condition

d) adequate funding for maintenance, conservation, storage, and the expenses related to the donation and installation of the work

e) unencumbered and clear legal title


Detailed Donation Procedures

1. Individuals wishing to donate works of art to the Malcove, University College or University of Toronto Art Collection should contact the Curator or Director of UTAC.

2. The donor should supply as much information as possible, ideally a description of the work, including artist, title, medium, size, date, provenance, etc. The donor should supply an image of the work, when possible.

3. The Director or Curator may consult appropriate members of the profession, if necessary, as part of the preliminary research on the object before it is brought to UTAC’s Acquisitions Committee. The Director/Curator will report any findings to the Acquisitions Committee.

4. The Director or Curator will determine, by all responsible means, before recommendations, that the donor has legal title to the object(s) in question.

5. The donor may be asked to release rights of copyright, if held by the donor. If copyright rests elsewhere, the laws of copyright will apply and be a matter of record at the time of the transaction.

6. If a donation is accepted by the Acquisitions Committee for the Malcove or University College Art Collection, the donor is notified by mail. The donor will also be issued a deed-of-gift form. Upon UTAC’s receipt of the completed and signed deed-of-gift form, the university will issue a tax receipt.

7. If a donation is accepted by the Acquisitions Committee for the University of Toronto Art Collection on the St. George campus, the Acquisitions Committee will send its recommendation to the University Art Committee for final institutional approval. If that approval is received, the donor is notified by mail. The donor will also be issued a deed-of-gift form. Upon UTAC’s receipt of the completed and signed deed-of-gift form, the university will issue a tax receipt.

8. Should the object be accepted into one of the three collections, the donor may apply for a tax receipt under two specific categories - that offered by the University of Toronto, or by the Canadian Cultural Property Export Review Board. Relevant cultural property applications will be made by UTAC staff.

9. The donor will normally bear the cost of professional outside appraisals of a work for the purposes of determining the amount of a tax receipt. The external appraisal should represent a fair market value at the time of the transaction. Should it not be possible to establish a fair market value, it may not be possible to issue a tax receipt.

10. The donor will normally bear all costs (appraisals, authentication, research, etc.) related to the submission of a work for certification as cultural property to the Canadian Cultural Property Export Review Board.

11. Should the donation require extensive and unusual conservation work, the costs must be borne by the donor.
